２４、工程預付款　　實行工程預付款的，雙方應當在專用條款內約定發包人向承包人預付工程款的時間和數額，開工后按約定的時間和比例逐次扣回。預付時間應不遲于約定的開工日期前7天。發包人不按約定預付，承包人在約定預付時間7天后向發包人發出要求預付的通知，發包人收到通知后仍不能按要求預付，承包人可在發出通知后7天停止施工，發包人應從約定應付之日起向承包人支付應付款的貸款利息，并承擔違約責任。

To execute the Advance Payment, Both parties shall define the amount and time of such payment made to Employer to Contractor, in the Particular Condition。 The amount of advance payment paid shall be deducted pro rata as per the specified time after commencement。 The Advance Payment shall be made not later than 7 days prior to the commencement date。 In such case the Employer fail to make such payment on the specified time, the contractor shall issue the notice of requesting the Advance Payment after 7 days after the specified time for the advance payment。 In such case the Employer fails to make the advance payment after receipt of Contractor’s notice, the Contractor is entitled to suspend the work after 7 days issuing the notice。 The Employer is obligated to pay to Contract the interests of loan for the due payment, and liable for the breach of Contract。 。
