2. RECIPEINT shall receive and hold INFORMATION and/or TEST MATERIAL in confidence and shall prevent the disclosure of INFORMATION and /or TEST MATERIAL. 3. Subject to Article 10 hereinbelow the obligations to confidentiality and non-use imposed on RECIPIENT under this Agreement shall expire seven (7) years from the date when RECIEPIENT receives the INFORMATION and/or TEST MATERIAL. 4. The obligations under this Agreement shall apply only to INFORMATION and/or TEST MATERIAL which is a) disclosed to RECIPIENT as a sample or in writing marked as confidential, orb) disclosed in any other manner, identified as confidential at the time of disclosure and reduced to writing delivered to RECIPIENT by DISCLOSER within thirty (30) days of the disclosure.
